Terms of Service

Commission ToS
By purchasing or owning a commission from me, you, the commissioner, are agreeing to follow the Terms of Service below. My Terms of Service are allowed to and subject to change at any time.
Section I. DEFINITIONS
riftlore (@riftlore on DeviantArt, @SalamanderMoon on DeviantArt/Toyhou.se, @riftlore on Twitter): I/me/my, the artist of the commission.
The commissioner: you/your, the customer who purchases the commission.
Commission: work/piece/artwork, the illustration produced for the commissioner.
Terms of Service: Terms/ToS/rules, the rules for commissioning me.
Blocklist: A list of names; names on the list are barred from purchasing works from me in the future.
Section II. GENERAL TERMS
The commissioner must follow all rules provided in these Terms of Service. Failure to do so will result in being placed on my blocklist.
You must stay up-to-date and keep up with any changes to my Terms of Service. By continuing to hold commissioner's privileges to the work, you are agreeing with any changes in the Terms of Service.
Any amendments made to my Terms of Service are effective immediately after being posted.
You must be transparent with me about any details relating to the purchase of the work itself and uses for the work. Any terms not listed in this Terms of Service must be discussed at length with me prior to the purchase of the commission. If you and I do not both agree to a term, it is not valid.
This Terms of Service may be moved to a different location at any point, and it will stay valid and binding for all commissioners. The new link to the Terms will replace some of the old links.

Section III. PAYMENT
All customers must pay in full upfront for the commission.
I accept U.S. Dollars ($USD) through PayPal. Payment must be sent within 24 hours of the agreement to purchase!
My work cannot be sold or bought for any form of cryptocurrency, and it cannot be turned into NFTs (non-fungible tokens) or otherwise minted on the blockchain.
Section IV. WORK PROCESS
Work-in-progress ("WIP") pictures can be provided for the commissioner at every major point of the piece:

The sketch.

The flat colors, if needed to confirm that the design has been depicted correctly.

For painted works, a WIP midway through the rendering process.
A work-in-progress picture will always be given at the sketch stage. If you would like a guaranteed WIP at a stage outlined above other than the sketch, please request one! Any non-sketch work-in-progress pictures will only be given upon request or at my discretion.

The time for the commission to be completed will vary, depending on factors such as:

My health (mental and physical)

My time available to work (I am a full-time college student!)

The complexity of the commission
If a delay occurs, you will be notified about it if it impacts turnaround time. I will not give any guaranteed finish dates, but I will do my best to have your piece done by any rough time estimate I give.
If you have a strict deadline, you must discuss it with me prior to the commission being accepted! Any failure to disclose deadlines beforehand means I will not go out of my way to adhere to them.
Section V. COMMISSION EDITS / CUSTOMER SATISFACTION
I will do everything I can to ensure you're satisfied with the work you receive. However, once you have approved the work at a milestone, I'm not required to let you make any changes to the work completed at that milestone later on. (ex. if you want to change the sketch after I've already started doing the flat colors.)
Please thoroughly review the WIPs I send you, and ask questions or request edits if something isn't to your liking! I would much rather make the edits early than have to try and do them later.
Regarding minor (small) changes:

Small changes can be made at the sketch and flat color stages for free. I'm more than happy to make small tweaks!

Minor changes include color palette, design, expression, or anatomy changes.
Regarding major (large) changes:

Large changes can only be made at the sketch stage. Any large changes may come with a fee.

Major changes include an outfit, pose, or background change, or anything that requires me to re-do a large portion of your commission.

Please be sure about what you are ordering before you place it on the form! It is up to you to be as clear as possible about what you want when you order. I can't accurately make your vision come to life if I don't know what your vision is!
Any changes requested may be declined at my discretion.
If I somehow miss a detail that was stated on your order form, please remind me of it and allow me to fix it. Fixes of this nature are always free!
Section VI. COPYRIGHT / USAGE POLICY
I hold the intellectual property (IP) and therefore the copyright to the entire work (the finished piece, work-in-progress shots, and sketches), not the commissioner.
Therefore, I am allowed to use the work to:

Promote myself in/on any place or website.

Use in a portfolio, or as an example of my work.

The commissioner is allowed to:
-
Use the finished commission for personal use only.
-
Display the finished commission on social media, so long as they visibly link back to one of my pages!

Claim the right of their character(s), but not the work itself.

Keep a high-resolution copy of the finished work that cannot be edited, traced, copied, or claimed. If the character(s) depicted in the work are sold to a new owner, this copy should be distributed to the character's new owner.

​If this copy is unwatermarked or unsigned, it should not be shared on social media. (A signed and watermarked version that you can share will also be provided in these instances.)

The commissioner is not allowed to:
-
Display or share the work without providing proper credit and a link back to me.

Edit, trace or heavily reference the work.
-
Use the work for commercial purposes.
-
Mint the work on the blockchain or turn it into a non-fungible token (NFT).
-
Use the work for anything related to cryptocurrency or web 3.0.
-
Infringe on my copyright of the work.

Any sketches and work-in-progress pictures made during the entirety of the commission time-frame, including scrapped or changed pieces, are owned exclusively by me and may not be used by the commissioner in any way. They are not to be distributed, shared, claimed, copied, traced, referenced, edited, posted, or re-posted by the commissioner.​
Section VII. CANCELLATION / REFUND POLICY
A commission may only be cancelled (with full refund given) if payment has not yet been sent! Once you have sent full payment and I have started on the commission, you cannot cancel or demand a full refund.
You may request a partial refund at any point; this refund will reflect the work that has been completed so far. (If none has been completed, the refund will most likely be in full.)
I am allowed to fully or partially refund a commission if I do not feel I can complete it.
If the commissioner files for a refund (or PayPal chargeback) against me, against my terms:

The commissioner will be added to my blocklist and barred from purchasing work from me.

The commissioner's name may be publicly posted, if I choose.

I have the right to file a complaint or contest the refund, and I am allowed to keep the money the commissioner gave me.

No statements in these Terms will be changed unless the commissioner has discussed such changes with me prior to the purchase.
Design ToS
By obtaining one of my designs in any way, you, the adopter, are agreeing to follow the Terms of Service below. My Terms of Service are allowed to and subject to change at any time.
Section I. DEFINITIONS
riftlore (@riftlore on DeviantArt, @SalamanderMoon on DeviantArt/Toyhou.se, @riftlore on Twitter): I/me/my, the original artist and creator of the design.
The adopter: you/your, the person who purchases and/or currently owns the design.
Adoptable: design/original work, a character design that I have created that is up for sale, along with the original art that displays the design. Purchasing the design and its corresponding artwork is considered 'adopting' it.
Custom design: an adoptable created for the customer, based on details given to me by that customer.
Terms of Service: Terms/ToS/rules, the rules for owning one of my designs.
Blocklist: A list of names; names on the list are barred from purchasing any of my designs/work in the future.

Section III. PAYMENT
All customers must pay in full upfront for the adoptable or custom design.
Payment should be done with either U.S. Dollars ($USD) or DeviantArt Points, which will be accepted only via PayPal or the DeviantArt website, respectively. Payment must be sent within 24 hours of the agreement to purchase, or the adoptable will be put back up for sale. If paying for an adoptable or custom design with DeviantArt Points, you must wait until I have stated how I desire the payment to be sent to me, be it gifts or the commissions widget.

Section IV. TRANSFERRING OWNERSHIP (RESELLING / TRADING / GIFTING)
The adopter should notify me when transferring ownership of one of my designs, so I can ensure the Terms of Service are being followed and update my records! When transferring ownership of one of my designs to a new owner, the old owner must link to these terms, so the new owner is aware of them and can agree to them.
Designs may only be resold for equal or lesser value than they were purchased for, unless:

The design has additional artwork to go with it. If so, the design may be resold for equal or lesser value of the original purchase price plus the price of any artwork.
Adoptables that have been traded or gifted may not be resold, unless:

The resale includes additional artwork. If so, they may be resold for equal or lesser value of the price of the extra artwork ONLY.
My designs may not be bought solely to flip and re-sell. Adopters found to be participating in shady re-sale practices will be added to my blocklist.

My designs may not be sold or bought for any form of cryptocurrency, and they may not be turned into non-fungible tokens (NFTs) or otherwise minted on the blockchain.
Section V. CREDITS
The adopter should credit me as the original designer at least the first time the design is drawn/used.
The adopter may upload the original work to their social media, provided that they visibly credit me as the creator of the design and work (including a working link back to my page.)
For uploads to toyhou.se specifically, you should correctly list the terms for resale and trade as they are found in this Terms of Service.
Section VI. COPYRIGHT / USAGE POLICY
I hold the intellectual property (IP) and therefore the copyright to the original artwork and design, not the adopter.
Therefore, I am allowed to use the copyrighted work to:

Promote myself in/on any place or website.

Use in a portfolio, or as an example of my work.

The adopter of the design is allowed to:

Use the design for personal use only.

Display the design on social media, so long as proper credit is provided (including a working link back to my page.)

Keep a high-resolution copy of the work that cannot be edited, traced, copied, or claimed. This copy should be distributed to any new adopter of the design, upon the design's re-sale.​

Slightly modify the design (i.e. change the eye color, make small hue shifts, adjust some of the markings) as long as it is still recognizable as the original design.

Claim the copyright to their character(s), but not the design or the original work itself.
The adopter of the design is not allowed to:
-
Display or share the original work on social media without providing proper credit.
-
Edit, trace, or heavily reference the original artwork.
-
Significantly modify the design so as to be unrecognizable.
-
Claim the design or original artwork as their own creation.
-
Use the design for commercial purposes.
-
Mint the design/work on the blockchain or turn it into a non-fungible token (NFT).
-
Use the design/work for anything related to cryptocurrency or web 3.0.
Section VII. CANCELLATION / REFUND POLICY
I have the right to cancel the purchase of a design if I wish to do so.
For pre-made adoptables: once you send full payment, there are no refunds! In the event you must cancel payment (i.e. if you won an auction for an adoptable but you cannot pay), I may warn you or add you to my blocklist if I see fit.
For custom designs: full refunds may only be given if I have not yet started on the design. Otherwise, a partial refund may be given, accounting for the work that has already been completed. Once I have sent you the finished design, you may not demand a refund from me under any circumstances.

If a refund is given, I have the right to finish and then sell the design at a later date.
If the adopter files for a refund (or PayPal chargeback) against me, against my terms:

The adopter will not be allowed to purchase designs or work from me again.

The adopter's name may be publicly posted anywhere I choose.

I have the right to file a complaint or contest the refund, and I am allowed to keep the money the adopter gave me.
